Mr. Massaroni is both a trial attorney and an employment law practitioner. His litigation and trial experience is quite broad and includes personal injury litigation (for both plaintiffs and defendants), commercial litigation, employment litigation, and medical professional licensing cases. Mr. Massaroni has been chosen by many national corporations to handle their self-insured personal injury defense cases in Upstate New York, and has experience in the asbestos mass-tort litigation. Mr. Massaroni also has broad experience in general commercial litigation, including contract disputes, cases involving intellectual property and claims of unfair competition, construction litigation, the litigation of shareholder suits, and disputes concerning the management of closely-held corporations.

In the employment field, Mr. Massaroni has a depth of experience not only in counselling management clients on employment matters, but also in negotiating and litigating employment disputes. His experience includes the representation of management in labor negotiations, the opposition of strike activities, the pursuit of claims of unfair labor practices, the arbitration of grievances, and the defense of discrimination claims in state and federal court and before the EEOC and the New York State Division of Human Rights.

Mr. Massaroni's recent engagements include the following:

  • The defense of employment discrimination charges against a medical practice, resulting in the dismissal of the charges and the issuance of a decision by the appellate court clarifying New York's election of remedies doctrine in employment cases.
  • The successful defense of negligence and product liability cases against a variety of manufacturers and other companies, including an airline, an elevator-escalator manufacturer, a manufacturer of power equipment, and others.
  • The representation of a minority shareholder of a multi-million dollar business in successful opposition to squeeze-out efforts by the majority shareholders.
  • The defense of a physician in a proceeding commenced by the Department of Health's Office of Professional Medical Conduct, resulting in the retention of the physician's license.
  • The successful pursuit of medical malpractice and negligence claims on behalf of individuals.

Mr. Massaroni is a graduate of Union College (summa cum laude) (1979), and Cornell Law School (1982), where he served as Articles Editor of the Cornell International Law Journal. Prior to joining the firm, Mr. Massaroni served as Law Clerk to the Hon. John A. Mackenzie, Chief Judge, U.S. District Court for the Eastern District of Virginia. He is a contributing author to Personal Injury Defense Techniques (Matthew Bender 1987); he serves on the board to the Albany-Colonie Chamber of Commerce's Business Services Corporation; and he is an occasional lecturer on trial techniques at continuing legal education seminars sponsored by the New York State Bar Association.
