Mr. Szary concentrates his practice in the area of litigation. During his career he has not only represented corporate and business clients in a wide range of commercial disputes, he also represents individuals in personal injury and wrongful death matters, especially those involving medical malpractice and products liability. He has extensive trial experience, trying cases in both state and federal courts in New York and elsewhere, in addition to administrative forums such as the Merit Systems Protection Board and commercial arbitrations conducted by the American Arbitration Association.
Mr. Szary's representative engagements include the following:
- Successfully litigated a contract dispute involving the sale of a power generating plant in the Republic of Colombia;
- Obtained substantial damage awards for injured plaintiffs in numerous complex medical malpractice matters involving issues such as vascular surgery, carpal tunnel surgery, failure to diagnose cancer and obstetrical malpractice;
- Won a $3.47 million verdict on behalf of a victim of psychiatric malpractice;
Litigation of strict products liability matters involving failure to guard industrial equipment, as well as defective design; - Litigation of premises liability cases involving negligent design, maintenance, and supervision, as well as toxic exposure to hazards like lead and carbon monoxide;
- Successfully represented a corporation that markets chemical compounds defending against alleged violations of the Lanham Act in a suit brought by a multi-billion dollar pharmaceutical company;
- Successfully represented the estate of a woman who succumbed to breast cancer against a medical insurance company which had denied a request for coverage of the cost of autologous bone marrow transplant;
- Successfully argued before the New York State Court of Appeals. (Mantica v. NYS Dept. of Health, 94 N.Y. 2d 58.)
Mr. Szary is a graduate of New York University School of Law, Class of 1990. He did his undergraduate work at the University of Albany where he graduated summa cum laude and was elected to Phi Beta Kappa.
